4. Whereas, "the Market" refers to trade of options and other recognized and accepted financial tools.

Both the MERCHANT and the Customer agree to engage in a commercial relation according to "the Market" boundaries and associated risks.
Как переводить UNDERSTANDING в названии документа? Я понимаю еще было бы AGREEMENT of UNDERSTANDING...

AGREEMENT UNDERSTANDING - "договоренность о соглашении" или "соглашение о договоренностях"
