Subject: про award law I discussed with Tom what options there are in relation to B/C breaches of the agreement.First, Tom is very clearly of the opinion that any attempt to assign the Award (or the underlying debt, which probably isn’t possible anyway because it is merged in the Award) would not only be very unlikely to lead to a situation where A (or another entity) could successfully rely on it in the future but also would be extremely dangerous in terms of potential impact on the settlement. Like me, Tom thinks there is a serious risk that acting in this way would be considered by a court to be fraudulent, leading to the settlement agreement being set aside/avoided. Tom’s very strong message is that you should not attempt to assign the Award or any underlying С debt. и несколькими предложениями позже In the unlikely event that the settlement agreement was set aside/declared void, the Award would come back to life anyway, because the release of it would fall away. Accordingly, all B would need to do is apply to restore C to the register. | Вынести решение о присуждении денежных средств, если рассуждать по логике вещей, то в Once restored, C could seek to enforce _the Award_ (Решение) because the settlement agreement would no longer be an impediment. |

как обычно, посмотрите поиском, много интересного найдете award - решение третейского суда assign an award - уступить (по цессии) права требования, вытекающие из вынесенного третейским ("арбитражным") судом решения settlement agreement - мировое соглашение set aside/avoided - отменен (судом общей юрисдикции), признан недействительным (и не создающим правовых последствий) |

теперь понятно спасибо что до поиска, я не первый раз уже от вас этот совет слышу, но тут, видимо, я не знаю какого-то секрета. если искать по award, вылезает "первые 240 результатов", в которых ctrl+f по assign = 0. если искать по assign award, то вылезает "первые 232 результата", в которых ctrl+f по award = 1 в строке поиска. и вообще не из той епархии всё показывает. гугловские кавычки-астериски не работают. |
