A detained person as defined in Articles 4 and 5 of the Geneva Convention Relative to the Treatment of Prisoners of War of 12 August 1949. In particular one who, while engaged in combat under orders of his government, is captured by the armed forces of the enemy. A POW can be a member of the armed forces, of a militia or volunteer corps, of the merchant marine or a civilian aircraft crew, or of groups spontaneously taking up arms to resist an invading force.

A combatant or other person belonging to one of the following categories who has fallen into the power of the enemy: a member of the armed forces of a party to the conflict as well as a member of militias or volunteer corps forming part of such armed forces; a member of other militias or other volunteer corps, including those of organized resistance movements belonging to a party to the conflict and operating in or outside their own territory, even if this territory is occupied, and who is commanded by a person responsible for his subordinates, has a fixed distinctive sign recognizable at a distance, carries arms openly and conducts operations in accordance with the laws and customs of war; 3. a member of regular armed forces who professes allegiance to a government or an authority not recognized by the detaining power; 4. a person who has received the authorization to accompany armed forces without actually being a member of these armed forces, such as a civilian member of a military aircraft crew, a war correspondent, a supply contractor, a member of a labour unit or of services responsible for the welfare of the armed forces and who carries an identity card issued by the latter; 5. a crew member of the merchant marine or of a civil aircraft of the parties to the conflict; 6. an inhabitant of a non-occupied territory who, on the approach of the enemy, spontaneously takes up arms to resist the invading forces, provided he carries arms openly and respects the laws and customs of war.
