8. If the Seller cancels this contract for the reasons set out in articles 4.2 or 6 above, or if the Seller approves a cancellation by the Buyer in accordance with article 7.1 above, the Buyer shall pay to the Seller a cancellation fee of 20 % of the price payable by the Buyer according to this contract, excluding VAT or any other taxes if applicable. This cancellation fee shall be considered as compensation for the Seller’s costs and expenses, including but not limited to depreciation as well as costs for storage, sales’ and handling. The cancellation fee shall be payable in the same currency as the price stated in this car order for the vehicle. The Seller may withhold any down payment made by the Buyer to the extent necessary to cover the cancellation fee.
