Absence of an overall policy framework or logic

The illogical structure of the Principles is encouraged by the lack of an overall policy framework for criminal justice and law enforcement – the importance of which is underlined by the Council of Europe. The size of the reform task taken on by Ukraine is major: reform of law enforcement in general, ranging from demilitarization of the police through reform of the security services to reform of the Public Prosecutor’s Office, all within the context of the fulfillment of cross-cutting objectives such as the fulfillment of human rights obligations. For such a task to be manageable and coherently tackled, it is vital that there is a clear statement of what the desired end-state is in terms of the exact role and powers of each institution within the law enforcement system.

To this end, it is recommended that the document is restructured and reworked so that:

- it begins with a clear statement of the current situation – (i) the key problems of the current system of law enforcement; (ii) the international standards to which Ukraine aspires.
- these are then translated into an overall policy framework, which would define what should be the status, role and basic powers and duties of each of the components of law enforcement: for example, that “the Public Prosecutor’s Office should be a formally and de facto independent institution with the role of prosecuting criminal offences, defending the public interest through the criminal justice system and supervising the observance of fundamental rights and liberties by the police”.
