Да, согласен. После долгого размышления я и сам пришел к выводу, что в изначальном тексте, который и представляет основной интерес, речь идет о том, что один орган (OFT) не стал передавать вопрос другому органу (Competition Commission), а принял меры самостоятельно.

Таким образом,
reference = "передача вопроса" (хотя ко второму примеру это не относится).
