Subject: capable of remedy The Borrower does not comply with any provision of the Finance Documents (other than those referred to in Clause 23.1 (Non-payment) and 23.2 (Financial covenants)) unless the failure to comply is, in the opinion of the Agent, capable of remedy and is remedied within five Business Days of the Agent giving notice to the Borrower or the Borrower becoming aware of the failure to comply.
