скажите пожалуйста во фразе fair wear and tear of the Goods by the Customer действительно не хватает глагола перед BY?

Excepting fair wear and tear of the Goods by the Customer, the Company warrants that all Goods delivered to the Customer will be free from defects in materials or workmanship.

IMHO, it seems that the clause may have been "Goods received by the Customer", because it seems improbable that a customer will inflict wear and tear on the Goods before the moment of delivery, however fair these wear and tear may turn out to be.

Maybe they mean that the Customer will wear and tear the Goods after the delivery; in that case, they are a tad off the mark in constructing the sentence.
