As a rule, the use of heavy fuel oil exceeding 1,00% by mass is to be prohibited (Article 3(1) of
the Sulphur in Fuels Directive). The term “heavy fuel oil needs to be defined in accordance with
Article 2 No 1. In other words, it covers fuels as defined by the classification in the European
Union’s Combined Nomenclature (alinea 1) or by the definition stipulated in the second alinea
of this provision. In other words, implementation must cover both products falling under the CN
codes and products falling under the definition given by the Directive itself.
