indemnification for commercial severance pay

Возникло несколько вопросов. Подскажите, пожалуйста, кто что может. Спасибо!

1. Речь идет о promotional discount. Что именно отражает ее сокращение? The reducing discount level reflects ХХХ build out of spares capability.

2. If ХХХ Software upgrades are covered under a valid software license, End User will be entitled to the upgrade at the upgraded level for the licensed ХХХ Hardware (не понятна часть от to the upgrade ...).

3. 13.9 In the event of termination of this Agreement for any reason, Integrator shall have no rights to damages or indemnification of any nature related to such termination (but not limiting any claim for damages it might have on account of ХХХ breach of this Agreement, even if the breach gave rise to termination, such liability being governed by and subject to the limitations set forth elsewhere in this Agreement), specifically including no rights to damages or indemnification for commercial severance pay, whether by way of loss of future revenues or profits, expenditures for promotion of the ХХХ products, or other commitments in connection with the business and good will of Integrator or indemnities for any termination of a business relationship (не понимаю часть "indemnification for commercial severance pay, whether by way of").

4. 1.11 Non-Genuine Products are any and all products to which a Mark or other ХХХ trademark or service mark has been affixed without ХХХ consent (Mark и trademark в этом контексте?).
