Речь идет о тендере.
Никак не могу четко изложить суть этого выражения - if the said agreement is to be entered into at arm’s length.
Выражение встречается в следующем контексте:

In the event of the Award (если выиграют тендер), the Parties agree that ...will be subject to consent of both Parties; such consent cannot be unreasonably withheld if the said agreement is to be entered into at arm’s length. The Parties further agree that already existing agreements to which the ... is a party and which were not entered into at arm’s length shall be terminated at the earliest date possible
