Особенно интересует: search in respect of, search of the Register, searches of the records, enrolled, pending suits or causes of action, public indexing system for suits or causes of action и degree of certainty.

We have carried out the following searches of public records which we considered appropriate in support of the opinions expressed herein:

3.1.1 a search in respect of the Borrower at the Registry of Companies in Malta; and

3.1.2 a search of the Register in respect of the Vessels at the Registry.

3.2 We have not carried out any searches of the records held at the Public Registry Offices as encumbrances against vessels registered in Malta are not enrolled therein.

3.3 We have not effected any searches at the Registry of the Superior Courts of Malta (nor with the registry of any other court or tribunal in Malta) for any pending suits or causes of action against or involving the Borrower; the public indexing system for suits or causes of action currently available does not permit the location and identification of suits or causes of action with an acceptable degree of certainty.
