В случае неисполнения или ненадлежащего исполнения Клиентом своих обязательств по оплате Векселей в соответствии с условиями, установленными пунктом 2 настоящего Договора, Банк вправе в одностороннем порядке отказаться от исполнения настоящего Договора, письменно уведомив об этом Клиента и возвратив ему поступившие в счет оплаты Векселей денежные средства.

In case of a failure to perform or the improper performance by the Client its obligations to pay for the Promissory notes in accordance with the Clause 2 hereof the Bank may unilaterally terminate this Agreement by giving a written notice to the Client and refund the money paid-in for Promissory Notes.

In case of non-performance or incomplete performance by Client of Client’s obligation to repay the Promissory Notes in accordance with Clause 2 of this Agreement, (the) Bank may unilaterally terminate this Agreement by giving a written notice to Client and refunding to Client all the moneys already paid for the Notes.

P.S. I think "incomplete performance" sounds better than "improper performance", but I don't know why. IMHO, "incomplete" means that there was something lacking or wrong in Client's performance, which is the meaning of the Russian "ненадлежащего". But which ever one you pick, I would not put an article before it. "The improper performance" would mean the performance was improper in some particular way, which you, then, must have defined. But you are simply talking about improper/incomplete performance in general here, right?

Also, for some reason, "the moneys" sounds better than "the money" in the last sentence, but you can use either.
