помимо воли и желания ...beyond the control of the Parties...(неточное соответствие, но формулировка частая)
делающие невозможными - preclude

gogolesque, Вы как-то уже спрашивали про выражение "понимать что-то под чем-то" (если я не ошибаюсь). Что-то не могу найти ту ветку. В данном Вашем примере можно сказать by which the Parties mean
Но я бы это предложение разбила на две части и вместо "под которыми стороны понимают" начала бы новое предложение - что-то типа Force Majeure Circumstances shall mean...
