взыскание here means foreclosure, and обратить взыскание means to foreclose upon some property/assets/whatever |

Посмотрел ветку, и возник вопрос к лоерам. Вот мне попадалось "обращение взыскания" как "levying execution (on)". В чем разница между to levy execution и foreclose? И употребителен ли вообще такой глагол to foreclose (чаще попадается foreclosure, поскольку "термин", как считается, стремится к номинативности, т.е., хочет быть существительным). Это я к тому, что, может, стоит переделывать некоторые конструкции так, чтобы они включали сущ-ные (типа, естественнее будет звучать), нет? |
Слава, я не лоер, но хочу заметить, что глагол таки-да, употребим (я сталкивался с ним весьма часто в текстах по ипотечной тематике), хотя и не столь часто, как foreclosure |

i agree with d. i have also seen it many times in english texts and contract (though i am not a lawyer) - i just have never seen the Russian for it and couldnt put it together. but even if it is wrong, i already had to give up the text.... that kind of day. no time to sit and mull over your mistakes and questions. :( |
Даниил, спасибо. gogolesque, I didn't mean "foreclosure" is wrong, It's just that I'm not a lawyer and just curious if "levying execution" and "foreclosure" are synonyms at all and if they're not, what's the difference. |

Slava its a good question i am not a lawyer either (so i dont know why i have so many legal documents here at work to translate lately) ..... maybe V can help us out here? V? |
d. is right. It's either "foreclose" (on the collateral or other security) or repossess (like the bank will repossess your house if u fall behind on ur mortgage payments) I don't like "execution" in this context. |
