Штраф и пеня

Доброго времени суток!В силу отсутствия юробразования очередной раз возникли сомнения в отношении понятияй штрафов и пени. В контракте есть и уплата штрафа и уплата пени в качестве ответственности. Понятия, по словам юриста, не равноценные. Использовались fine и penalty, соответственно.

Имеет место быть или в корне неправ?

Штраф — это единократное принудительное удержание финансовых средств, а пеня может начисляться многократно, плюс процентики.

После тщательного и серьезного анализа вопроса я пришел к выводу, что по смыслу "Штраф и пеня" и "fine and penalty" - это разные вещи. Fine может назначить государственный орган, а если это делает частная компания, то это уже не fine , а penalty.

Пеня = default charge / late charge (т. е. взимается повременно за просрочку исполнения). Штраф можно назвать и fine, но я обычно пишу penalty

ШУрИК, и все же... Конь-текст :))) Извините за каламбур, не особо их люблю. Но приведите абзац, без конфиденциальной информации. Или там просто перечисляются расходы на оплату штрафов, пеней и т.д.?

Да, к сожалению, просто проценты. Пеня при просрочке оплаты/поставки . Штраф - при отсутствии, но и плюс пеня. И чисто штраф если нет качества

Кстати, хорошее словечко - fee. Тогда, получается, в таких случаях лучше использовать в качестве штрафа - penalty, а как пеню - fee ну или fine. Правильно понимаю? Хотя тут пеня никакими властями не накладывается...
