Выражение встречается в следующем контексте:
If the Customer appears reasonably to the Supplier due to the Customer’s credit rating to be financially incapable of meeting its obligations under the Contract, then the Supplier shall have the right to exercise any or all of the rights set out in clause 9.2 below.
