Всем привет! Помогите, пожалуйста, перевести данную фразу:
"For the purposes of a Covered Tax Agreement, income derived by or through an entity or
arrangement that is treated as wholly or partly fiscally transparent under the tax law of either Contracting
Jurisdiction shall be considered to be income of a resident of a Contracting Jurisdiction but only to the
extent that the income is treated, for purposes of taxation by that Contracting Jurisdiction, as the income of
a resident of that Contracting Jurisdiction".

"It contains a provision described in paragraph 4 which identifies in detail the treatment of specific fact patterns and types of entities or arrangements treatment of specific fact patterns and types of entities or arrangements".

Эти фразы используются в контексте международного налогообложения, а именно в Многосторонней Конвенции по выполнению мер, относящихся к налоговым соглашениям, в целях противодействия размыванию налогооблагаемой базы и выводу прибыли из-под налогообложения.

а что вызывает затруднение?

Вот эта часть затруднительна в первой фразе - "income derived by or through an entity or
arrangement that is treated as wholly or partly fiscally transparent" - криво получается перевести - "доход, полученный организацией или через нее, или договоренность, которая считается полностью или частично освобождаемой от налогообложения/фискально прозрачной" - получается какой-то бред. И сильно смущает вот эта "договоренность" arrangement...

А во второй "the treatment of specific fact patterns and types of entities or arrangements" - вообще теряюсь... и снова эти arrangements...

"arrangement" в данном случае понимается как "структура" (траст, фонд и т.д.).

Кто-нибудь может подсказать, как перевести этот кусочек? Вроде остальное все прояснилось - the treatment of specific fact patterns.

Вот фраза полностью, в контексте которой не ясна указанная выше формулировка: "Paragraph 1 (as it may be modified by paragraph 3) shall apply in place of or in the absence of provisions of a Covered Tax Agreement to the extent that they address whether income derived by or through entities or arrangements that are treated as fiscally transparent under the tax law of either Contracting Jurisdiction (whether through a general rule or by identifying in detail the treatment of specific fact patterns and types of entities or arrangements) shall be treated as income of a resident of a Contracting Jurisdiction.
