(в одном месте в оригинале - institution, в другом - institute)...

Возможно, для такого довольно абстрактного текста подойдут столь же абстрактные, но свойственные юстиции термины, как, напр., "арбитражное ведомство" или "арбитражная инстанция"? К ним же относится Ваш вариант "арбитражный орган", а вот "учреждение" и "институт" довольно далеки от того смысла, в каком здесь употреблено это англ. выражение.
Это только моё личное восприятие. Возможно, поступят другие предложения.
