помогите плиз перевести "established its factual case"
в контексте
- The Tribunal did not consider that Electrabel had established its factual case that, on the evidence, one or more breaches of the FET standard, causing loss to Electrabel, were committed by Hungary in failing timeously to take reasonable steps to protect Electrabel before the European Commission’s Final Decision ....

мой вариант
- Состав арбитража не посчитал (установил?), что компания Electrabel доказала на основании представленных фактов, что .....

кас. "не посчитал" - как-то коряво, хотя в документе, из которого взята исх. информация, написано "The Tribunal does not consider... " и соответственно "..не считает" звучит нормально

'to establish a case (for or against s.o./sth)' = (of parties/their lawyers in a court/tribunal hearing) 'to provide (sufficient evidence/a good enough argument) to persuade the court/tribunal to decide in their favour'

Example:
* 'The judge freed the prisoner after deciding that the police hadn't established a case against him' = after deciding the police (had insufficient evidence/didn't have a strong enough argument) to convict him'.

So here, it's saying that the tribunal felt that Electrabel didn't have a strong enough argument (in terms of factual evidence) to persuade it that Hungary was at fault.

As well as:

The Tribunal did not consider (refused to consider/ take in consideration) that Electrabel had established its factual case ( The gays from Electrabel established a good case, but bad boys from Tribunal ignored it. )

Amor: I think 'did not consider that Electrabel had' here just means 'considered [ie, thought] that Electrabel had not'. 'to consider' is a slightly higher-register (more officialese/more pompous) form of the standard English 'to think'.

If the author had meant 'ignored' (either deliberately or accidentally), he'd probably have written:
* 'did not consider the fact that Electrabel had',
* 'did not take into consideration the fact that',
* 'did not take into account the fact that',
* 'ignored the fact that',
or sth similar.

Good point, though.
