(документ: Order (Application by which the applicants are seeking appointment of the suitable arbitrator).

У меня пока одна догадка: "conduct"(noun) = "conducting the (arbitration/conciliation) proceedings" = ""

Как целиком вы перевели бы фразу, выделенную жирным шрифтом?

Similar is the case in the matter of XXXXX Versus XXXXX, reported in *** .
The Apex Court therein had referring to the arbitration clause, held that:

The parties had intended to enter in the arbitration agreement for deciding all the questions and dispute arisen between them through arbitration and thereby concluding the jurisdiction of ordinary civil Courts. Such reference to arbitration, however, was required to be preceded by a decision of Superintendent Engineer and challenge to such decision within 28 days by party feeling aggrieved therewith. The steps preceding coming into operation the arbitration clause though essentially are capable of being waived, the conduct in that regard should disclose such waiver.

Если можно, пожалуйста, еще подскажите следующее:
to refer the matter (/case/claim/dispute) for conciliation — направить дело (/иск?/ иск/ спор) на урегулирование с помощью согласительной процедуры (/путем примирения?)?
и
to refer the matter (/case/claim/dispute) for arbitration — направить дело (/иск?/ иск/ спор) на арбитражное разбирательство (/для? а.р.)

Еще одно:
seek to do smth + be sought to be done — это все "усиления" (не всегда отражаемые в переводе на русский) подобно "shall", или здесь и правовой нюанс какой есть?
Уж слишком много этих sought to be drawn/referred и т.д. по тексту..

The said two letters thus, undoubtedly refers to acceptance or receipt of certain amount and calculation about the amount due and payable to XXX.
It is, however, not understood nor anywhere it is explained as to how the dispute sought to be raised under the present application is the same as that of the subject matter of those two letters.

Что автор текста, по-вашему, вложил в seek тут?
М.б., путает его с is going (to be raised)?

должно быть have sought - respondents have filed... and have sought
Здесь не то, чтобы "нежелательность", хотя автор текста, похоже, не в восторге от всего этого. Имеется в виду, что respondents стремились к/предпринимали действия, направленные на... Поскольку есть прямое указание на действующее лицо, то никаких недомолвок в стиле "не будем говорить, кто" уже нет.
