The Seller shall not be liable to make payment in respect of any Claim based upon a
liability which is contingent unless and until such contingent liability becomes an
actual liability, provided that the time limit in the proviso to paragraph 3.1 shall be
amended in relation to such Claim which is an Additional Warranty Claim so as to
require that legal proceedings be commenced within six (6) months from the date on
which the said liability ceases to be contingent, in order for the liability of the Seller not
to determine.
