В договоре речь идет о тех. обслуживании координатно-измерительных устройств.
Maintenance agreement § 12 Liability:
(2)
Claims to loss of profits, saved expenditure, from third-party claims to damages, claims for reimbursement of damage incurred on objects other than the Company product in question, as well as other indirect and consequential damage shall be excluded, unless a property feature guaranteed by the Company has the precise purpose of securing Customer against such damage. Требования возмещения упущенной прибыли …..за исключением случаев, когда property feature, гарантированная Компанией имеет целью защитить Заказчика от такого ущерба. ????? (3)
The limitations and exclusions of liability in sub-sections 1 and 2 shall not apply for claims originating due to deceitful conduct on the part of the Company or for liability for guaranteed property features, for claims according to the Product Liability Act or for damage from injury to life, limb or health. (3)
Ограничение и исключение ответственности в п. 1 и 2 не распространяется на претензии, связанные с обманным поведением со стороны Компании, на ответственность за гарантированные характеристики объекта ????, на претензии согласно Закону о качестве выпускаемой продукции или на ущерб от телесных повреждений, опасных для жизни и здоровья.
