Both PURCHASER and SUPPLIER shall commit to the financial flow traceability obligations required by art. 3 of Italian Law no. 136 of 2010. In particular the payment shall be made into a dedicated bank account; in any case of non-compliance with the above, the Purchase Order shall be terminated. Therefore, the
SUPPLIER commits to provide the appropriate declaration, drawn up as per "FORM-COR-PROC-040-E", which indicates the identification details of the dedicated bank account where all payments shall be made, details and fiscal codes of the persons empowered to operate on it. Any change to any details of such dedicated bank account shall be immediately notified to the PURCHASER. In addition, SUPPLIER shall declare, as per "FORM-COR-PROC-041-E", to comply with the obligations of the aforesaid Italian Law in all of its contracts by and between the same SUPPLIER and any of its Sub-Contractor(s) or Sub-Supplier(s). [If applicable: in case of public works to be performed in the Italian territory] Tender documentations which are not prepared and submitted in accordance with all the requirements set forth in the Request For Quotation may be rejected outright by PURCHASER.
After review, PURCHASER may require clarifications and/or discussions with individual Tenderers prior to final selection.
Tenderer hereby confirms that, if invited, he shall provide requested clarifications at no cost to PURCHASER.
At any time during the tendering period, PURCHASER reserves the right to request Tenderer to make available the sample(s) of Goods to be purchased under the present Request for Quotation. Tenderer if so requested shall provide the sample(s) at no cost to PURCHASER and within the period indicated by PURCHASER.
