1. Положение во время брака
Own property of each spouse:
1. items and personal belongings intended for the exclusive personal use of a married person,
2. property which belongs to a spouse before orat the beginning of the ordinary matrimonial regime (at the marriage) or which a spouse received during marriage by succession or as a gift (donation),
3. items and assets which belonged to a spouse’s own property and are replace, such replacement belongs again to the spouse’s own property
4. moral compensation. Acquisitions of each spouse:
1. income from husband’s and wife’s work,
2. payments received by social insurance or other social institutions,
3. compensation received in case of incapacity to work,
4. item which is part of the acquisition and needs to be replaced, such replacement is again part of the acquisitions,
5. revenues or interest received from a spouse’s own property, unless it has been stipulated in a marriage agreement that such revenues do not belong to the acquisitions but will again be the wife’s or the husband’s own property (art. 199 para. 2 CC). General information:
During marriage, the ordinary matrimonial property regime of participation in acquisitions does not really differ from the regime of separate estate, since each spouse retains ownership of his/her own estate and manages his/her own estate separately. The same is true for the acquisitions of each spouse. These can be used and managed independently by each spouse. However, in case of dissolution of the matrimonial property, their jointly acquired property (acquisition of each spouse) is divided between the spouses in equal shares (please see sheet 2).
