Как Вы переводите слово "witnessth"?

Контекст такой:

This Memorandum of Agreement is concluded between Company A and Company B, etc. (Как обычно пишут, в начале договора).

Потом идет это:

WITNESSTH:
WHEREAS, ....

Можно ли просто написать "ПРЕАМБУЛА" и далее
ПРИНИМАЯ ВО ВНИМАНИЕ ТО, ЧТО или УЧИТЫВАЯ ТО, ЧТО.
У меня сомнения по поводу слова "witnessth".

Есть ли еще какие-нибудь варианты?

Witnessth - Another form of Preamble in the contracts, used usually together with "whereas; now, therefore".

Witnesseth - Legal jargon meaning "to take notice of," used in phrases such as "On this day I do hereby witnesseth the signing of this document."
