If the Deliverables are to be mixed or used with other goods (or goods supplied by the Customer) or any process is to be applied to the Deliverables by the Company, in accordance with any specifications or instructions of the Customer, the Customer shall indemnify the Company against all loss, damage, costs, expense and liability incurred by or awarded against or agreed to be paid by the Company in connection with or in settlement of any claim (a) relating to the safety or suitability of the combined goods and Deliverables or (b) for infringement of any copyright, patent or other intellectual property right of any third party, resulting directly or indirectly or as a consequence of the use by the Company of the Customer’s specification or following the Customer’s instructions.
