Does anyone know how translate legal term 'преюдиция' - a situation in law when a court is bound by the findings of fact made by another court in a separate case?

It is quite amazing but the translators of the Russian Code of Criminal Procedure used the term prejudice. I think this is wrong but anyway:

'Article 90. Prejudice
The circumstances, established by the sentence which has come into legal force, shall be recognized by the court, by the prosecutor, by the investigator and by the inquirer without an additional verification, unless these circumstances raise the court's doubts. Such sentence, however, cannot prejudge the guilt of the persons, who have not taken part in
the criminal case under consideration earlier.'

Before anybody gets too enthusiastic about the 'authority' of Article 90. Prejudice, it should be pointed out that this was clearly translated into English by a Russian or, just maybe, some English native speaker strung out on dope. To wit, it contains numerous mistakes of punctuation and style. In short, not exactly reliable for translation purposes.

А по-моему, это и есть самая что ни на есть prejudice, т.е., предубежденность. В английском (в широком смысле слова) праве такой нормы нет, именно потому, что считается, что предубежденность -- это плохо. Соответственно, после того, как О.Дж. Симпсон был признан невиновным в убийстве Николь Браун и Рональда Голдмана, на него по-прежнему можно было подать в суд в гражданском порядке за ущерб, причиненный убийством, и выиграть дело. Тот факт, что Симпсон был признан невиновным в уголовном суде, для гражданского суда не значил абсолютно ничего.
