пенсионер - человек получающий пенсию, а пенсию человек может получать не только потому что он retired, но и потому что он к примеру является инвалидом. тут мне могут возразить сказав что в конечном счёте если он инвалид то он has retired. но ведь многие инвалиды и работают и получают пенсию.

i guess you are right then. in US law, retirement refers to 'voluntary retirement from office, public station, business or other employment'. invalids receive 'disability' benefits.

I am not sure, actually. But I think you should be guided by the origin of your document. If you're translating a piece of Russian legislation or contract, then it has to be clear within the given context. If you are translating a US document, then I would probably differentiate between disability and retirement. Perhaps someone else is better versed in these matters. Sorry.
