Respondent, as a result of both the severe general economic downturn, and a massive fraudulent diversion of funds by its former senior managers, is admittedly unable to pay its creditors. It has therefore entered into a voluntary debt restructuring process in an effort to treat all of its creditors fairly, with a view to maximizing the long term recovery on their claims while preserving Respondent’s business to the greatest extent possible. This process, in which substantially all of Respondent’s creditors are participating, promises to yield a better result for all creditors than a race to the court house (or in this case, the arbitration forum) by a few creditors attempting to dismember Respondent through enforcement of arbitral awards against its very limited assets, most of which are subject to prior liens and pledges.
