We agree with the conclusions of that advice that – although there is no specific concept of good faith under English law – a tribunal would assess the extent of the Parties’ obligations in the Agreement in light of the inclusion of the good faith qualifier.

Я бы употребил слово «критерий».

в данном контексте я бы сказала "оговорка" - Соглашение содержит не критерии добросовестности, а оговорки о добросовестности
