Добрый день всем,

возникла проблема с этим предложением из раздела об арбитраже:

The award of the arbitrators may be, alternatively or cumulatively, for monetary damages or an order requiring the performance of obligations (including specific performance or injunctive relief) or any other appropriate order or remedy.

мой вариант:

Решение арбитров может требовать, в качестве альтернативы или совокупно, в качестве возмещения денежных убытков или заказа [или здесь имеется в виду «ордер»?], исполнения обязательств (включая реальное исполнение либо судебный запрет) либо любой другой соответствующий ордер или средство правовой защиты.

контекст:

Any dispute, controversy or claim arising from or in connection with this Agreement shall be exclusively referred to and finally resolved by arbitration under the LCIA Rules, which Rules are deemed to be incorporated by reference into this clause. The number of arbitrators shall be three. XXX shall nominate one arbitrator and YYY shall nominate one arbitrator within a period of 30 days from the date on which the defendant party or parties have received the claimant’s notice of arbitration. If XXX or YYY fail to nominate an arbitrator within the period provided for above, the LCIA Court will act as the appointing authority with respect to such arbitrator. The designated two arbitrators shall nominate a third arbitrator within 30 days of the nomination of the second arbitrator. In the event the arbitrators cannot agree on the third, the LCIA Court shall appoint the third arbitrator, who shall not be a resident or citizen of Ukraine. The seat, or legal place, of arbitration shall be London, England. The language of the arbitration proceedings shall be English. The IBA Rules of Evidence shall apply to the arbitration. Any award rendered by the arbitrators shall be in writing, setting forth the reasons for the award, and shall be the final disposition on the merits, and the parties agree to execute such award. In the event that any of the parties hereto fails to execute the arbitrators’ award, the successful party or parties may turn to a court of competent jurisdiction with a petition to issue a decision on the execution of the arbitrators’ award. The award of the arbitrators may be, alternatively or cumulatively, for monetary damages or an order requiring the performance of obligations (including specific performance or injunctive relief) or any other appropriate order or remedy. The arbitrators may issue interim awards and order any provisional measures which should be taken to preserve the respective rights of any party.

Вариант:
Арбитражное решение может предусматривать возмещение убытков в денежной форме или (в качестве дополнительной или альтернативной меры правовой защиты) содержать приказ об исполнении обязательств (включая исполнение в натуре либо судебный запрет) либо любые другие соответствующие приказы или средства правовой защиты.
