No liability shall attach to the Vendor either in contract or in tort for loss, injury or damage sustained by reason of any defect in the Equipment if such a damage, loss or injury is a result of the default of the on Site existing infrastructure that was not supplied by the Vendor.

Может быть подойдет "неисправная работа"? Потому что такая инфраструктура бывает "недопоставленной" сторонами.
