AGREEMENT
ON THE USE OF THE BUILD ONLINE INTERNET PLATFORM

This Agreement shall regulate use of the BUILD ONLINE internet platform (CTSpace) by persons who are not employed by ХХХХ or any subsidiary or affiliate of ХХ, in connection with projects (Project Space) (“Project”) of ХХ or any subsidiary or affiliate of ХХ.

SUBJECT OF THE AGREEMENT:

1. The User or any other person involved in a Project who is authorised as a “staff member” or “guest” to use the BUILD ONLINE internet platform for the duration of such Project undertakes to use the folder structure determined by the ХХ project administrator and to use folders released to his/her use solely for filing purposes (drawings, protocols, correspondence, etc.).
2. This Agreement shall commence upon its signature by the User and ХХ. It shall be valid until the User has rendered his/her full performance and it shall automatically terminate upon complete performance by the User.
3. Uploading/filing by the User of any data unrelated to a Project in a folder released to the User for use as set out above shall not be permitted because the data volume for each Project Space is contractually agreed between ХХ and BUILD ONLINE and therefore limited. Any additional charges (additional costs) caused by the unauthorised filing of data unrelated to a Project or Project Space shall always be borne by the User as the responsible party and shall be charged to the User in his/her capacity of responsible party.
4. Only the project administrator involved shall be allowed to create a new folder in addition to the existing and authorised folder structure and to assign access authorisation to such folder or any other folder.
5. The User’s authorisation shall be limited solely to using the BUILD ONLINE internet platform as set out above. The User shall therefore under no circumstances be permitted to use the BUILD ONLINE internet platform for any other purpose nor to pass on any data or passwords.
6. The User understands and agrees that the additional cost for any data in excess of the prescribed limit shall be € 000.– per month and gigabyte, which shall be fully charged to the User in his/her capacity of responsible party.

7. ХХ shall not accept any responsibility whatsoever for any functional failure, for whatever reason, of the BUILD ONLINE internet platform.

8. The User shall be responsible for any and all contents filed by him/her or any person acting on his/her behalf. ХХ shall not accept any responsibility whatsoever.

9. If the User should act contrary to the provisions of this Agreement, ХХ reserves the right at any time to prohibit the User from using the BUILD ONLINE internet platform. In such event the User shall have no claim for compensation whatsoever.

10. No additions or changes to this Agreement shall be valid except when made in writing and signed by both parties.

11. If any provision of this Agreement should be found to be partly or wholly invalid or unenforceable, this shall not affect the validity or enforceability of the other provisions. Such invalid or unenforceable provision shall be replaced by another provision which shall be as close as possible in its economic effect to the invalid or unenforceable provision.

Огромное спасибо! и встречный вопрос как правильно это транслитерировать Билд Онлайн? или вообще с этим не заморачиваться, а писать как есть: на чуждом нам языке?)))
