Any dispute as to whether a defect is covered by the Warranty shall be immediately referred to an expert to be agreed by the Company and the Customer (or in default of agreement to be appointed by the Board of Conveyors of the Czech Chamber of Commerce and Industry) whose decision shall be final and binding upon the parties and whose fees shall be shared equally by the parties
