in my Oxford Dictionary of Law I have:
Due diligence
The legal obligation of state to exercise all reasonable efforts to protect aliens and their property in the host state. Such aliens must have been permitted entry into the host state. If there is a lack or failure of due diligence the state in default is held responsible and liable to make compensation for injury to the alien or to the alien's estate.
