Subject: Перевожу контракт - с русского на англ. слово преемник как можно перевести? gen. Доброе утро!Помогите, пожалуйста, с переводом слова преемник на английский. «Преемник» - юридическое лицо, принимающее на себя исполнение обязанности «Должника» по оплате «Кредитору» за выполненные «Кредитором» работы по договору «Должнику». В МТ есть много вариантов, но не знаю, о таком ли преемнике идет речь. Заранее благодарю. |

Если это контрактный термин (определение которого приводится в тексте контракта), то можно брать практически любой "вариант из МТ", он ведь все равно будет иметь (в данном контракте) вполне определенное значение. А конкретно по теме - я бы написал Expromissor. |

Здесь речь не о праве, а об обязанности. И не о передаче, а о принятии. Одно от другого неотделимо, но есть нюансы. Это примерно как передать кому-то свой телефон и передать кому-то долг за свой купленный в кредит телефон... |

Вот этот "преемник" succeeds the Debtor's duty/obligation to pay the Lender for its work performed under the Agreement (or hereunder, если это отрывок из договора). И кто он после этого? Поясните (если можете), что означает последнее слово «Должнику». Уж не выполненные ли "Должнику" (в смысле, для Должника) работы? |

The words you are looking for are assignee (приеемник), debtor (должник) and lender (кредитор). This paragraph is not in good Russian. The author of the contract should've written договору with a capital Д. indicating that it is THIS contract. If not, you'll get a different meaning here. I'd say that On balance, I'd say use translate.google, then edit it, and you're done. |

One useful trick: In MS Word press Ctr+H and replace all the terms like приемник, должник and dozens of others with their English counterparts. You'll instantly have hundreds of tough terms translated. Then paste the whole document into translate.google, then edit the bad google translation. After checking the end result you are done. I once translated a difficult technical document (30 pages!!!) from Russian into perfect English using this technique in one hour! At the same time Russian guys simply freak out when something like that needs to be translated into English. |

Erdferkel, you are replacing приемник with 'Assignee' in the whole contract using this technique. Just one click and it is done. I normally bowdlerize heavily the document, changing the order of sentences, removing redundancies and inserting some additions. Sometimes I even offer a neutral layout so that the document looks okay in both English and Russian. Translators don’t do that. They just follow the text, keeping the structure of another language the way it is and making the result unnatural. So translate.google is gonna be okay, unless you are really into heavy editing and proofreading according to some manual of style, which is never the case. |

I'm not a robot and typing mistakes DO occur whether we like it or not. There was no mistake in my original post. Level 100% is a level of a very well educated Russian person. It is still not perfect if you should ask. Even professors of Russian language and literature are not perfect in my opinion and they are not higher than 11.0 (or 110%) because I don't think that they have gargantuan vocabularies or that they are exceptional at solving crossword puzzles. |

DUPLESSIS, just an afterthought Some Americans really don’t know that ‘gonna’ is an intentional way of representing colloquial language. Some people know nothing about descriptivism, prescriptivism or linguistics. Even on this very website the vast majority has no idea of what linguistics really is. Learning the Rosental by heart doesn’t mean you’ve made it and your Russian is out of reach. You will still be prone to mistypings. And your vocabulary is a totally different story – it still can be mediocre, good, excellent or exceptional. As for me, learning the Rosental and some other books inside out doesn’t mean that I should stick it to other people. I’d rather not. But some folks, having learned an ounce of the Rosental, exactly do that -- stick it to others, to slightly less literate people, and call them некультурными. I never do that because I studied linguistics and know better than that. I, on the contrary, sometimes show to those snobs who learned a tad of prim and proper Russian their place. Drawing on my expertise, I can annihilate their shallow knowledge by picking holes here and there, poking fun at either their poor Russian vocabulary, or punctuation, or something else. What goes around comes around!!! |

DUPLESSIS, I’m gonna try to explain those levels. First of all, I think there are no tests to assess language at a very high level. You can assess only grammar, spelling and quality of speech, and that’s it. But our modern language is all about technical words and idioms whether we like it or not. We learn all that stuff in schools and universities. It’s at least 50% of the language. Nobody tests or assesses it. They assess only our knowledge of various subjects (history, chemistry, economics, business law etc.). Having received a good university education, I additionally studied a lot, and definitely know Russian better than an average well-educated guy. I specifically delved into Russian on my own to enhance my knowledge, though it, of course, was not needed anywhere except for proofreaders, journalists etc., but I don’t work in that field. Truth be told, I had some arguments with them, calling into question the quality of their work. As to my scale: I’d say the theoretical maximum is around 12.0: Most people with a good university education should be in the ballpark of 10.0 in my opinion. Someone truly exceptional can be around 11.0, but I’m not that good. Simply put, 17 or more years of education in some language (11 at school + 6 at university) = around level 10.0, provided you were a very good student. So, if you had studied in a Russian school and at a Russian university for 17 years and had been getting good grades, then, DUPLESSIS, you are automatically at level 10.0 or higher. What about 9.0? I guess if you can translate simultaneously (after some training, of course) into some language, then that language is at level 9.0. For that you need around 10 years of education in that language (or in that country), but 17 years would be overkill in my opinion. What about level 8? Well, that’s when you are exceptionally good at simultaneous interpreting (level B). It’s higher than C2, Proficiency. Level 7: That’s proficiency, C2. Some claim that C2 is close to native speakers. Yes, if a native speaker is a household speaker. Example: a Spanish kid emigrates to the US at age 7 and continues to speak Spanish at home while studying and socializing in English. Well, you may say that his Spanish is C2 when he goes back to Spain, say, after 15 years of living in the US. Well, Spaniards will speak Spanish way better than he does with his pathetic C2 kinda native level (50% of vocabulary will be missing: chemistry, history and all other subjects and much more). C2 is of course the be-all and and-all for foreigners. Even some (household) native speakers are far worse than C2 -- that's a fact. Well, I guess, I'm starting to go off on a tangent (towards linguistics). |

As I said before there are no tests for complex scientific analysis of very high native language levels, but the main vocabulary can be tested (it'll be only 50% with the other 50% being writing skills, listening comprehension, idioms, speech, science and technology related vocabulary). Assume, a very well educated native speaker (17 years of education) is 10.0. Then 12.0 is a projected figure against this 10.0 benchmark. Or would you rather assume the maximum is 15.0? Would you really assume so high a number against a very well ed'd person? If 10.0 is a very well educated native speaker and 5.0 is at upper-intermediate level, do you really think that there can be another native speaker (15.0) who is better than 10.0 by such a sweeping margin (+5.0) as a 10.0 guy is better than a 5.0 guy. Not possible, not a chance. But you can set the max at 13.0 for some genius. That's common sense, man. |

Some more explan'n: It should be crystal clear that some C2 level is way way below a 10.0 mark. We set this 10.0 at the level of a very well educated native speaker (17 years of educ'n, probably 25-30 years of living in the country where the said language is spoken). C2 will probably requires 10 years of living in another country, while having some decent IQ (= being not some numskull). |

My opinion about C2: you need at least 5 years to achieve this level. It's about as many words as is in an old En-Ru dict'ry for 20,000 words. Plus idioms, correct grammar, blah, blah. A genius probably can achieve this faster. Normally it should be 10 years of living in the country whose language you study. |

As I said, it is just common sense. You may shift it two points down, making a 10.0 mark unattainable. Then C2 should be at a 5.0., my Ru at a 8.5, En at a 7.5. Bottom line: there is a huge gap between a "full-fledged comprehensive knowledge of our native tongue" and some C2 of foreigners. |

Yes. But all I did was setting a 10.0 scale against various levels. It is neither logic, nor common sense to set the max mark at some fantastic far-fetched level of some genius. So, why not just a well educated native speaker? Or why should I stack up my Russian against some foreign C2 level? Assume setting the foreign C2 level to be 10.0. Then what? Should my Russian be 1000.0 or what? That just doesn't add up. Or should I invent some new scale for native speakers? What number should I tie it to? People know such systems as CEFR C1, C2, B2, Level A, B (in interpreting). Why not set against those numbers? So I did. Hence: 1 - a beginner, 2, 3, 4, 5, 6, 7, 8, 9, 10 - a well educated native person. Or should a 10 be an astronomical genius? Then the system collapses. You have to divide everything by 2 - that sounds weird and illogical. |

Basically, I did nothing at all. I just designated numbers starting from 1, going to 7 (C2), then 8 (level (B)), 9 (level (A)), and finally 10 (well-educated native speaker). Man, I just counted them. That's all. |
