Subject: CRYSTALLISE
КОНТЕКСТ:

The Guarantor shall not crystallise or terminate its liability under this Guarantee
whilst any part of the Guaranteed Obligations remains outstanding or any
Beneficiary remains under any liability under or in connection with the Finance
Documents (whether to continue to make the Facility available or otherwise).
(b) For the avoidance of doubt, if the Guarantor seeks to crystallise or terminate its
liability under this Guarantee (without the consent of the Security Trustee), the
Beneficiaries may after receiving notice that the Guarantor intends to crystallise
and/or terminate its liability continue to give credit and make further advances to
the Principal and this Guarantee will apply to such credit and advances.
5. BREAKING OF RUNNING ACCOUNTS
(a) If this Guarantee crystallises, terminates, is determined or ceases for any reason to
be binding on the Guarantor as a continuing security in relation to the Principal,
then any Beneficiary may break such accounts of the Principal with such Beneficiary
as it deems appropriate and open a new account for the account holders affected or
accounts in the name of the Dutch Parent.
