It is worth noting that the participation exemption system in the Netherlands is a very well established feature of the tax code. The general principle of the exemption has been in place for a considerable time. Please note that it is proposed to abolish this non-portfolio investment test from 2007, which would make possible non-applicability of the participation exemption a temporary issue. There is a doctrine in the Netherlands that allocates the value fluctuations of a subsidiary to the period in which the participation exemption did or did not apply (compartmentalisation doctrine).

Предположу: наверное, проверяют/оценивают, подходит ли инвестиция под определение "портфельной", или же все-таки это именно participation... ну, стратегические инвестиции. Видимо, устанавливается какая-то планка, меньше которой инвестиция относится к портфельной, и тогда освобождение от налогов на нее/доходы от нее не распространяется.

Еще раз: только предположение.

Под "планкой" я имела в виду процент от капитала. Совершенно не знаю нидерландского законодательства, поэтому большего сказать не могу.

Participation exemption
In connection with EU developments, it is proposed to abolish the non-portfolio investment test for the application of the participation exemption to income derived from shares in foreign companies. The only condition for the application of the participation exemption will be the ownership of an interest of 5% or more. The possibility to apply the participation exemption under certain conditions to interests of less than 5% will be abolished.
With regard to an interest of 5% or more in a passive subsidiary the participation exemption will only apply if the profits of the subsidiary are adequately taxed. If this “subject to tax”-requirement is not fulfilled, a credit system will be applicable. This means that additional taxes will be levied up to the Netherlands tax rate on (distributed) profits. The Paper does not mention
the criteria for the subject to tax-requirement. However, it is indicated that in regular EU relations the participation exemption should apply.
The treatment of interests in investment institutions (operation under a privileged tax regime) remains unchanged: neither an exemption, nor a tax credit will be available.
