Moreover, any other interpretation of the Energy Charter Treaty would be inconsistent with Russian law. Under the Russian Law on Foreign Investments and the Law on Investment Activity, and predecessor legislation, to qualify as an “investment” an injection of foreign capital into the territory of the Russian Federation is required. This legislation had at its essential purpose the attraction of new funds and experience into the Russian/Soviet economy. Mere redistribution of capital among Russian and foreign subjects of law does not qualify as an “investment.” Any arbitration purportedly based upon an investment that does not involve an injection of foreign capital into Russia would thus fall squarely within the inconsistency clause in Article 45(1) of the Treaty.

Предлагаю такой вариант:
Любой арбитраж, предположительно основывающийся на инвестиции, которая не вызывает привлечения иностранного капитала в Россию, будет таким образом прямо подпадать под положение о несовместимости (несообразности, непоследовательности, противоречивости) в статье 45(1) настоящего Договора.
