Коллеги! У кого-нибудь было в контракте такой пункт? Помогите с русским вариантом!
To the extent that cover is not granted under the insurances (such as Contractor’s General and Product Liability or Erection All Risk insurance) the total liability of each Party and their respective employees, directors, officers and contractors for any reasons or legal grounds, including but not limited to direct damages, penalties, liquidated damages, indirect or consequential damages, being losses or costs arising from negligence, breach of contract or otherwise under or in connection with this Agreement or any Purchase Order (DirectTotal Damages Cap) shall be limited to [12] per cent of the contract price, however, in no case exceeding EUR [750.000 €]. However, The total liability of each Party and their respective employees, directors, officers and contractors for indirect damages, including, without limitation, loss of business profits, business interruption, loss of use, loss of production, loss of contracts or for any incidental or consequential damages (Indirect or Consequential Damages Cap) shall be limited to [5] per cent of the contract price (for the avoidance of doubt) within the Total Damages Cap above, however, in no case exceeding EUR [250.000 €].
