Есть вот такое положение в договоре касательно уровня ответственности сторон.

The Maximum cap liability of... shall be up to the amount of direct costs for services that are the subject of this Agreement.

This shall be applied in regard to the services .... has directly or indirectly provided to the Student, or on some other basis related to the services that .... has directly or indirectly provided to the Student or to any of its clients.

Including but not limited to the costs of attorneys and attorneys' fees incurred in connection with investigative actions in the lawsuit, proceeding or ongoing proceedings, which are expected or confirmed in relation to the injured party as a result of the breach of this Agreement, irrespective of whether it is the party Injured in the dispute or, in the case of a defence in a confirmed or possible lawsuit, from a dispute or procedure under this Agreement initiated by the Student, its representatives, client of the School for any breach of any Service or negligence of the SSBM in the performance of his services under this Agreement.

Вот в эту часть совсем не могу "въехать": "whether it is the party injured in the dispute or, in the case of a defence in a confirmed or possible lawsuit, from a dispute or procedure under this Agreement"

Буду благодарен если поможете разобраться. Лично я это пока вижу как "независимо от того, является ли эта сторона потерпевшей в споре или, в случае если такая сторона является ответчиком в подтвержденном или возможном судебном разбирательстве, потерпевшей вследствие спора или процедур..." В общем, пока сильно сомневаюсь, что правильно уловил суть.

Думаю, вы правы. Если коротко, проигравшая сторона оплачивает как своих юристов, так и юристов другой стороны.

Интересно, насколько правомерно с лингвистической точки зрения выражение injured in the dispute. Никогда не встречал
