Any settlement or discharge between Carlsberg and Partner and/or Guarantor will be conditional upon no security or payment to Carlsberg by Partner, Guarantor or any other person being avoided, set aside, refunded or reduced, and, should this occur, Carlsberg may recover the value or amount of such security or payment from Guarantor as if such settlement or discharge had not occurred.
