а между diligence и information не может подразумеваться предлог ? То есть "с должной добросовестностью предоставить информацию/доступ к (непонятно - о руководстве, к материалам о руководстве или что-то другое)...

Нет, не может, т.к. далее идет следующее:

• Scope of Bidder’s diligence:
- the Bidder may request that certain legal and financial documentation and information be provided to it (which may be provided through an electronic data room) and may request that it be permitted to meet with members of the Company’s management to discuss the Company’s business with;
- diligence is generally more limited than for a transaction involving a company with no listed securities;

alex, у вас тут diligence употреблен как короткий вариант due diligence

т.п. процесс сбора информации, проведения экспертизы, изучения и т.п.
