Declaratory judgments

Under English law and procedure, a party to a contract can seek a declaration as to the satisfaction or non-satisfaction of interim conditions to the parties’ ultimate rights and obligations under the contract, even though such rights and obligations have not yet matured and final performance is not yet due.

Раньше было Declaratory judgment, потом исправили на declaration...Перевод от этого меняется?

"деклараторное решение (определение)": хоть такой термин когда-то кем-то и введен, звучит, по-моему, некрасиво. Может быть, было бы лучше "решение (определение) декларативного характера"?
