В случае непоставки товара Продавец возвращает сумму авансового платежа не позднее 10 дней на основании выставленного требования Покупателя.
Мой вариант:
In case of non-delivery, the SELLER is to reimburse the amount of the payment in advance not later than 10 days or on account of alleged claim of the BUYER
