скорее всего речь идёт о том, что содержащееся в прецеденте или в законодательстве правило, на основе которого должно было быть принято решение, не относится к наиболее известным и часто употребляемым, поэтому до него просто "не докопались". Не нашли в правовой базе данных, в дайджестах по подобным делам — в общем, не было у них ready access.

A number of familiar reasons can be advanced to explain why rules or standards are misinterpreted. Imagine that a large federal agency is charged with enforcing Rule A by adjudication. At first blush Rule A seems very clear and readily comprehensible, but when applied by the agency it appears quite uncertain, unstable, and insecure.
