Абзац из пункта в договоре:

All notices, consents and other communications under or regarding this Agreement shall be in writing and shall be deemed to have been received on the earlier of the date of actual receipt, the third business day after being mailed by first class certified air mail, or the first business day after being sent by a reputable overnight delivery service.

Все вроде понятно, только смущает фраза shall be deemed to have been received on the earlier of the date of actual receipt, никак не могу понять, что здесь имеется в виду.

будут считаться полученным в тот день, который наступит ранее: день фактического получения, третий рабочий день после (...) или первый рабочий день после (...)
