нейтральный вариант — «ссылаясь на». Однако в этом случае мы утрачиваем негативную окраску (прошу прощения за каламбур), которая, как мне кажется, здесь имеется.

Пожалуй, русский юридический язык менее архаичен, менее эмоционально окрашен и менее поэтичен, чем английский юридический. Поэтому трудно подобрать слово, которое одновременно и отражает эмоцию, и соответствует стилю русской юридической речи.
