4. CORRESPONDENT’S OBLIGATIONS
IN CONSIDERATION of the performance of Company’s obligations set out under Section 5 hereof, Correspondent hereby agrees as follows:
(a) To accept Trust Funds from Customers desiring to transfer funds to designated beneficiaries through Company’s international network for the payment of money remittances. To forward payment order instructions to Company instructing that funds be delivered to a particular beneficiary.
(b) To deposit daily all such Trust Funds into the Trust Account and upon receipt of confirmation of payment from Company pursuant to 3.1(d) herein, to instruct bank to electronically transfer Trust Funds in Trust Account into Company’s designated bank account.
(c) Correspondent shall be absolutely liable to Company for the amounts received by it from customers, in its capacity as a Sending Correspondent, for the provision of money remittance services and, until such trust funds are deposited into Company’s bank account, Correspondent assumes all risks in any such amounts.
(d) Correspondent shall be deemed a trustee and Correspondent shall act as a fiduciary with respect to Trust Funds/cash amounts in its possession that have been received from customers for transfer.
